Background & Objectives

The Senior Managers and Certification Regime (SMCR) aims to reduce harm to consumers and strengthen market integrity by setting standards of personal conduct for everyone working in financial services, in an environment where conduct and fair customer outcomes are at the forefront of firms’ business models.  These standards of behaviour are set out in the Conduct Rules.

As the Conduct Rules apply to individual members of staff directly, they help to shape the culture, standards and policies of firms as a whole and promote positive behaviours that reduce harm. The Conduct Rules are intended to improve standards of individual behaviour to improve individual accountability and awareness of personal conduct issues across firms in financial services from the top down and the bottom up.  Firms are required to ensure that all their staff are fully trained on the Conduct Rules and understand how these Rules impact their job roles.

Securing awareness and maintaining understanding of the Conduct Rules is a continuing process which requires regular reinforcement. The Conduct Rules require regular revisiting and refreshing to ensure that everyone subject to them continues to understand their application in the context of their current working environment.  For firms involved in retail business, the new Consumer Duty heightens further the obligations on individual members of staff at all levels through the new Conduct Rule 6.

This interactive workshop will help participants by reinforcing their knowledge of the Conduct Rules and deepening their understanding about what is expected of them in the context of the work they do. The workshop involves the use of polls, breakout groups and case studies to illustrate learning points and to promote engagement with topics under discussion.

  1. Recognise the Conduct Rules which apply to them
  2. Consider how the Conduct Rules apply to their specific job roles
  3. Explore the impact of the obligations created by the Consumer Duty
  4. Identify issues and behaviours which could lead to a breach of the Conduct Rules.
  5. Understand the personal implications for individuals who breach a Conduct Rule, both now and in the longer term
  6. Ensure and demonstrate compliance with SMCR requirements

Who will benefit?

 

All staff subject to the Conduct Rules. The course is equally appropriate for established staff and for recent joiners. It is also suitable as a refresher for Senior Managers and Certified staff who should have been trained initially on the Conduct Rules at the commencement of SMCR.  Whilst the references to the Consumer Duty are mainly relevant to firms involved in retail business, this course is also appropriate for staff from firms engaged in wholesale and institutional business only.

** The core agenda addresses the five Individual Conduct Rules and the Senior Managers Conduct Rules are only given a passing mention. For participants who are (or may soon be) approved as Senior Managers, there will be a short, supplementary session to look at the Senior Managers Conduct Rules in more detail. There will be no charge for this supplement which is offered to all participants. It will follow-on from the end of the main session after a short break and last approximately 20 minutes.
